The petitioner seeks regular bail in connection with Hilsa P.S. Case No. 162 of 2018 registered for offences punishable under Sections 25(1-B)A, 26/35 Arms Act of the Indian Penal Code.

Allegation against the petitioner is the recovery of one pistol and cartridges from him.

Submission of the learned counsel for the petitioner is that FIR shows that pistol and cartridges were recovered from the truck of the driver seat of the tempo whereas seizure list shows that it was recovered from the conscious possession of the petitioner and the petitioner is in custody since 06.05.2018. Heard learned A.P.P. also who have opposed the prayer for

Patna High Court Cr.Misc. No.45492 of 2018 (3) dt.10-09-2018 2/2 bail and also submitted that petitioner is accused in four other cases.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of bail to the petitioner at this stage, however, once the charge is framed against the petitioner, learned trial Court is directed to release the petitioner on his own satisfaction.
