JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2023 The present writ petition has been filed seeking the following reliefs:- "1.(A) For issuance of an appropriate Writ / order/ direction directing the respondents to not construct building of Shambhuganj police station on 5 decimal land of plot No. 187 under Khata No. 160 and 8 decimal land of plot No. 188 under Khata No. 170 situated under Village- Karsop, P.S.- Shambhuganj District Banka which belongs to the petitioner and her five sons.

(B) Further for direction to the respondents

Patna High Court CWJC No.22784 of 2019(3) dt.01-08-2023 2/2 concerned to acquire the aforesaid 13 decimal of land according to Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 first and pay compensation to the petitioner of the said land and thereafter construct building of Shambhuganj police station over the said land."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a suit before the learned civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty so sought is granted.
