Petitioner seeks bail in Pipra P.S. Case No.16 of 2018 instituted for the offence under Section(s) 363, 366(A)/34 Indian Penal Code.

Counsel for the petitioner submits that the victim girl has given her statement under Section(s) 164 Cr.P.C., wherein, she has not levelled any allegation of specific overt act against this petitioner. Petitioner is said to be in custody since 01.04.2018.

In the written report, the informant alleged that this petitioner along with Raushan Kumar Yadav and his mother had kidnapped the daughter of informant.

There is no any allegation of specific overt act

Patna High Court Cr.Misc. No.42263 of 2018 (3) dt.24-09-2018 2/2 against the petitioner in the written report. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 3rd, Supaul in connection with Pipra P.S. Case No.16 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
