The petitioners, who are in custody since 16.09.2019, seek bail in connection with Special Case No. 8327 of 2019 arising out of Gopalpur P.S. Case No. 276 of 2019 dated 15.09.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition Act, 2016. It has been alleged that on seeing the police party, the petitioners began to flee away but were apprehended and from their possession 8, 7 and 10 litres of liquor respectively was recovered.

It has been submitted on behalf of the

Patna High Court CR. MISC. No.71654 of 2019(2) dt.04-12-2019 2/2 petitioners that the recovery has been shown only for the purpose of falsely implicating them. Petitioner no. 3, though has a case to her credit which was lodged sometimes in the year 2017 in which she is on bail but petitioners no. 1 and 2 have clean antecedent. Regard being had to the nature of accusation against the petitioners and the period of custody, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 8327 of 2019, arising out of Gopalpur P.S.
