2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 392 and 34 of the Indian Penal Code pending in the learned court below.
3. As per the prosecution case, three miscreants riding on a motorcycle entered in C.S.P. Centre of the informant and on the point of Arms they snatched Rs.1,10,000/- and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is not named in the FIR He submits that during the investigation one person was apprehended by the police who disclosed the name of the petitioner. He further submits that petitioner has got two
Patna High Court CR. MISC. No.80784 of 2023(2) dt.19-12-2023 2/2 criminal antecedents as stated in para-3 of the bail application.
5. Per contra, learned APP for the State vehemently opposing the bail application and submits that the petitioner has two criminal antecedents in similar nature of the offence. Hence, he does not deserve anticipatory bail.
6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Guthni P.S. Case No. 13 of 2020. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
