JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This case has been listed today under the heading "To Be Mentioned" at the instance of the petitioners. Submission of learned counsel for the petitioners is that the petitioners had filed the application for grant of anticipatory bail and vide order dated 18.12.2019, petitioners were granted the privilege of anticipatory bail, however, in the said order, the provisions of regular bail has inadvertently been mentioned.
Perused the order dated 18.12.2019, learned counsel for the petitioners appear to be right in his submission. Accordingly, wherever, regular bail mentioned in the order dated 18.12.2019, the same be read as anticipatory bail
Patna High Court CR. MISC. No.76651 of 2019(4) dt.09-01-2020 2/2 and further last paragraph of the order is modified to the extent that the same be read as:
"Having heard both sides, in view of the facts and circumstances as state above, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, learned Judicial Magistrate -1st Class, Patna, in connection with Mahila P.S. Case No. 119 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned".
Let a copy of this order be communicated to the concerned court below forthwith.
