The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Dhoraiya P.S. Case No. 107 of 2019 registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code. The allegation is regarding the petitioner having kidnapped the daughter of the informant for the purposes of forcibly marrying her.

The learned counsel for the petitioner has referred to the statement of the victim girl made under Section 164 Cr.P.C. before the learned Magistrate and has submitted that the victim girl has herself denied that any untoward incident had taken place with her and in fact has also not blamed the petitioner of

Patna High Court CR. MISC. No.72385 of 2019(2) dt.25-11-2019 2/2 having established any physical relation. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 25.06.2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 107 of 2019.
