1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of regular bail in connection with Bhore P.S. Case no. 444 of 2023 registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the gold ornaments etc. details of which have been given in the FIR, was stolen from his house and he suspects the four named accused persons including the three petitioners herein to have given effect to the theft.

4. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.83038 of 2023(2) dt.10-01-2024 2/2 petitioners that the petitioners have been falsely implicated in the case. From perusal of the FIR it transpires that the informant is not an eyewitness. Contrary to the allegations, no incriminating article has been recovered from the petitioners' house or possession. The petitioners are in custody since 7.9.2023, have no criminal antecedent and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners, the petitioners being in custody for more than 4 months since 7.9.2023, chargesheet having been submitted in the case and specially them not having any criminal antecedents, the Court directs the petitioners to be enlarged on bail in connection with Bhore P.S. Case no.444 of 2023 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
