2. The petitioner seeks regular bail in connection with Ramgarh Chowk P.S. Case No. 48 of 2024, registered for the offences punishable under Sections 323, 341, 379, 326, 504 and 506 of the Indian Penal Code.
3. The prosecution case is to the effect that the informant has alleged that he was demanding his rightful money from the petitioner upon which the petitioner is said to have assaulted the informant with a brick which hit his right eye causing damage to the right eye. The informant also alleged that Rs. 10,000/- (Rupees ten thousand) and the bicycle of the informant was also snatched and taken away by the petitioner.

Learned counsel for the petitioner submits that though there is allegation of assault on the informant is upon the petitioner however, from the perusal of the assault itself no case under Section 326 of the I.P.C. is made out and even from the perusal of the medical report it does not bear as to whether the eyes of the informant was completely damaged. The learned counsel next submits that the petitioner has clean and he is languishing in jail since 20.09.2024.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions made by the respective parties and taking into consideration the clean antecedent and the period of custody undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Lakhisarai in connection with Ramgarh Chowk P.S. Case No. 48 of 2024.
