JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This application, for grant of anticipatory bail, arises out of Kochadhaman (Bishanpur O.P.) P.S. Case No. 27 of 2019, disclosing offences under Sections 420, 379, 411/34 of the Indian Penal Code.

Allegation as per F.I.R. is that one miscreant exchanged the ATM card of the informant, who was later on apprehended by the informant and he disclosed the name of petitioner as his associate and it appears that petitioner is accused in one more case.

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of confessional statement of the co-accused and except that there is nothing against the petitioner and he has falsely been implicated in this case and the F.I.R also disclosed that only one person was

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman (Bishanpur O.P.) P.S. Case No. 27 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
