2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 308 (4) (5) and 3 (5) of the BNS, 2023.
3. The case of the prosecution is that the informant along with his friends had gone to Jharkhand where they consumed alcohol. While they were returning to their village, five persons intercepted them, took away the keys of their motorcycles, demanded extortion money, snatched Rs. 14,000/- from their pockets and also took gold chain from the informant. It is further alleged that the co-accused, namely, Nitish Kumar,
Patna High Court CR. MISC. No.76584 of 2025(2) dt.19-11-2025 2/3 forcibly transferred Rs. 34,000/- from the mobile of the informant's mobile phone through a scanner application.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further contended that the petitioner is merely a driver of the Scorpio, resides within the jurisdiction of Govindpur police station and also used to drive the vehicle as per the direction of the SHO. It is further submitted that co-accused, namely, Nitish Kumar against whom the serious allegation of forcibly transferring Rs. 34,000/- from the informant's account stands has been granted bail vide order dated 10.11.2025 passed in Cr. Misc. No. 72188 of 2025. It is argued that the case of the petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 15.08.2025 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Govindpur P.S. Case No. 250 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
