JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 21.2.2017 passed in Cr.Misc.No. 7796 of 2017 and allegation against the petitioner is of kidnapping of the daughter of the informant.

Submission of learned counsel for the petitioner is that except allegation of kidnapping there is no other allegation against him and so far allegation of physical intercourse is concerned, the same is against other co-accused and petitioner is in custody for two years.

Heard learned APP also.

Having heard both sides and in the facts and circumstances and also considering the period of detention, let the petitioner, named above, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.47051 of 2018 (5) dt.05-09-2018 2/2 bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-I, Barh, in connection with Sessions Trial No. 393 of 2018, arising out of Athmangola P.S.Case No. 79 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
