The petitioner, who is in custody, seeks bail in connection with Mahila P.S. Case No. 114 of 2017 registered for the offences punishable under Section 354(B) of the Indian Penal Code and under Section 4/8 of Protection of Children from Sexual Offences, (POCSO) Act.
Allegation against petitioner is of attempting to outrage modesty and using filthy language to the niece of the informant when she had gone to his house for tuition. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that occurrence took place on 09.06.2017 but FIR has lodged on 11.06.2017. Petitioner is in
Patna High Court Cr.Misc. No.44420 of 2018(5) dt.27-09-2018 2/2 custody since 30.05.2018.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st -cum-Special Judge, Nalanda at Bihar Sharif, in connection with Mahila P.S. Case No. 114 of 2017.
