The petitioner seeks bail in a case registered under Sections 302 and 201/34 of the Indian Penal Code. Petitioner along with other accused persons are said to have committed murder of one Mukesh Kumar over illicit affair of the deceased with the cousin of co-accused Sanoj Kumar Chaudhary.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. There is no eye witness of the occurrence. Spy has not named the petitioner in the occurrence. There is nothing cogent on record indicating the complicity of the petitioner in

Patna High Court CR. MISC. No.70581 of 2019(3) dt.11-12-2019 2/2 the occurrence barring the confessional statement of co-accused Sanoj Kumar Mahto which has no evidentiary value in the eye of law. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Said Sanoj Kumar Mahto has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 07.11.2019 passed in Cr. Misc. No. 64431 of 2019. Petitioner is a lady and she has no criminal antecedent and has been languishing in custody since 01.09.2019.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Daraunda P.S. Case No. 257 of 2018.
