Petitioner seeks regular bail in connection with Special Case No.1291 of 2019, arising out of Jogbani P.S.Case No.282 of 2019, for the offence punishable under Sections 30(a), 38(i) of the Bihar Prohibition & Excise Act, 2016. The allegation against the petitioner is that a total quantity of 9 litres of illicit liquor has been recovered from the motorcycle of the petitioner.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has not committed any offence in the manner alleged. Learned counsel further submits that illicit liquor has been seized without complying the provisions of Section 100 Cr.P.C. by the police.

Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 25.09.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria, in connection with Special Case No.1291 of 2019, arising out of Jogbani P.S.Case No.282 of 2019.
