The petitioner seeks bail in a case registered under Sections- 341, 323, 379, 504/34 of the Indian Penal Code and Section 8 of the POCSO Act.
The prosecution case, in brief, is that in course of returning from coaching, four persons eve teased the victim/informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 01-03-2018 and the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in this case due to mistake of fact. The petitioner has remained in custody for more than six months. It is a case of
Patna High Court Cr.Misc. No.47561 of 2018 (3) dt.13-09-2018 eve-teasing.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional District and Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with Muffasil (Banuchhapar) P.S. Case No. 31 of 2018.
