The petitioner, who is in custody, seeks bail in connection with Jamui P.S. Case No. 307 of 2012 registered for the offence punishable under Sections 302, 201, 376, 34 of the Indian Penal Code.

FIR was lodged against unknown persons. It is alleged in the FIR that on 10.11.2012 informant alongwith her daughter namely Sonam Kumari had gone for washing clothes. During washing her daughter told that she is going to her house and when informant reached her house at 5.00 PM she did not found her daughter, even after much search she could not be located. On the next day i.e. 11.11.2012 informant's son came

Patna High Court Cr.Misc. No.51003 of 2018(3) dt.04-10-2018 2/2 and told that dead body of Sonam is lying in the field of Arhar near the river. When informant reached there, she saw that her daughter Sonam is lying dead and she claimed that some unknown persons have killed her daughter.

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR and he has been falsely implicated in this case merely on suspicion. There is no eye witness of the occurrence. Petitioner has no criminal antecedent and he is in custody since 20.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui, in connection with Jamui P.S. Case No. 307 of 2012.
