The petitioner, who is in custody, seeks bail in connection with Bhadwar P.S. Case No. 19 of 2017 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

It has been alleged that petitioner who is the informant had confessed that she had three sons, namely, Surendra Basfor, Ganga Basfor and Jamuna Basfor. One of the son Surendra Basfor (deceased) had married on his own but had deserted his wife. Thereafter the deceased used to abuse and assault her and her two sons. On 03.12.2017 at about 9.00 PM Surendra Basfor (deceased) started abusing and assaulting her, in the meantime her two sons also came. She hit the

Patna High Court Cr.Misc. No.31330 of 2018(4) dt.05-09-2018 2/2 deceased with a stick and other two sons too assaulted the Surendra Basfor (deceased), as a result of which Surendra Basfor fell on the ground and died.

It has been submitted on behalf of the petitioner that petitioner is old lady and mother of the deceased. She has been made accused on the basis of her confessional statement. Petitioner has no criminal antecedent and she is in custody since 04.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st class Judicial Magistrate, Sherghati, Gaya, in connection with Bhadwar P.S. Case No. 19 of 2017. (S. Kumar, J) veena/- U T
