The petitioners are apprehending their arrest in a case registered under Sections 363, 366(A) and 34 of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, in short, is that the accused persons kidnapped the daughter of the informant. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. On recovery, the statement of the victim has been

Patna High Court CR. MISC. No.70858 of 2019(2) dt.16-11-2019 2/2 recorded under Section 164 Cr.P.C. in which she has not named the petitioners. The petitioners have been made accused because they happen to be the parents of co-accused Dhiraj Kumar. On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st,West, Muzaffarpur in connection with Saraiya P.S. Case No. 612/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
