Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.
The petitioner is not named in the FIR. Some other persons are named in the FIR as suspect of the crime of murder, they have already been allowed bail in Cr.Misc. No. 40407 of 2017 and Cr.Misc.No. 63093 of 2017. Learned counsel for the informant opposed the prayer for bail.
Considering the fact that only material that came during investigation against the petitioner is suspicion, let the petitioner, above named, be released on bail on
Patna High Court Cr.Misc. No.31418 of 2018 (4) dt.25-08-2018 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Azimabad Police Station Case No.02 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
