====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-11-2019 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in a case for the offence registered under Sections 147, 148, 149, 341, 323, 302, 120(B) of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the petitioners and other accused persons armed with country made pistol, causing the death of the son of the informant, namely, Ramun Kumar.

It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 22.04.2019. Charge sheet has been submitted in the present

Patna High Court CR. MISC. No.71743 of 2019(2) dt.19-11-2019 2/2 case. The petitioners have falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The specific allegation of assault is against Bihari Rai who is alleged to have fired upon the deceased. As far as petitioners are concerned, they are members of unlawful assembly. Neither allegation of assault is alleged against the petitioners nor any injury is attributed against the petitioners. Other co-accused person has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 67461 of 2019 under order dated 15.11.2019.

On behalf of the State and the informant, it is submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-7th, Danapur, in connection with Sessions Trial No. 928 of 2019 (arising out of Maner P.S. Case No. 200 of 2019).
