====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 05-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Mirganj P.S. Case No. 139 of 2017 registered for the offences punishable under Section 302 of the Indian Penal Code.

Informant Payal Kinnar in a written complaint stated that deceased Nisha Kinnar was running a dance and singing party. The marriage of Nisha Kinnar was solemnized with petitioner. It is stated that on 21.05.2017 a programme was held at Sasa Musa in which the petitioner accompanied the said party and some altercation took place between petitioner and Nisha Kinnar. Thereafter other kinnar intervened and pacify them and went to sleep, in the morning petitioner awoke them

Patna High Court Cr.Misc. No.32570 of 2018(6) dt.05-09-2018 2/2 and told that Nisha Kinnar committed suicide by hanging herself. Thereafter before arrival of police petitioner fled away. It has been alleged that petitioner killed Nisha Kinnar by hanging her.

It has been submitted on behalf of the petitioner that he is innocent and committed no offence. He has been falsely implicated in this case only on suspicion. He has no criminal antecedent and he is in custody since 08.12.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XVI, Gopalganj in connection with Mirganj P.S. Case No. 139 of 2017.
