This application for regular bail arises out of Rajgir P.S. Case No. 293 of 2019, disclosing offence punishable under Sections 420, 406, 467, 468, 471, 120-B of the Indian Penal Code.
It is alleged in the FIR that the informant had negotiated with one Rekha Sinha for purchase of a piece of land. On payment of consideration amount, a registered sale-deed was subsequently executed. After execution of the sale-deed, it is the case of the prosecution that the informant learnt that the lady, who had executed the sale-deed in favour of the informant's wife, had impersonated herself. Patna High Court CR. MISC. No.75204 of 2019(3) dt.04-06-2020 2/2 mentioned in the FIR as one of the conspirators in the entire transaction. The petitioner, who is a lady, is in custody since 02.09.2019.
It is the petitioner's case that she had no concern with said Rekha Sinha and that there is no specific role, allegedly, played by the petitioner in alleged defrauding the informant. Considering the nature of accusation as present in the FIR, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir P.S.
