JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Vidyapati Nagar P.S. Case No. 113 of 2019 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Petitioner is said to have put Gamcha around the neck of the informant and pulled the same. The impugned order goes to show that ligature mark was found on the neck of the informant.

However, learned counsel appearing for the petitioner submits that both parties have compromised the case and good sense has already prevailed between them.

No.69903 of 2019(2) dt.18-12-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition stands disposed of with direction to petitioner to surrender before the court below within six weeks from today and if petitioner does so and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this order, particularly, keeping in mind the factum of compromise arrived at between the parties.
