Heard learned counsel for the petitioner Nos.1 and 3 to 4 and learned APP for the State.
Petitioners apprehend their arrest in K. Hat P.S. Case No.926 of 2017 instituted for the offence under Section(s) 224, 225, 353/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Purnea.
It is alleged in the written report that on 08.12.2018 petitioners had surrendered in the Court of the Chief Judicial
Patna High Court Cr.Misc. No.44226 of 2018 (3) dt.01-08-2018 2/2 Magistrate, Purnea, in connection with Dhamdaha P.S. Case No.270 of 2017, and they were taken into custody, but taking advantage of the crowd they fled away after manhandling with guard and staff of the Court.
First Information Report has been lodged by the GR Clerk of the Chief Judicial Magistrate, Purnea. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner Nos.1, and 3 to 4 for grant of anticipatory bail is rejected.
Petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
