JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2019 The petitioner has challenged the order dated 07.09.2019 passed by the Sub-Divisional Officer, Barh, Patna contained in Memo No. 358 whereby the PDS license of the petitioner has been cancelled. Learned counsel for the petitioner submits that the order does not state the details of the persons who had complained against the irregularities in running of the PDS shop of the petitioner.

However, these issues can be agitated before

Patna High Court CWJC No.24571 of 2019(2) dt.10-12-2019 2/2 the appellate authority.

On the aforesaid fact being noted, the learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to prefer an appeal against the order impugned in the present petition before the appellate authority.

Should such an appeal be filed within a period of three weeks, the same shall be disposed of by the appellate authority within the statutory period of sixty days as provided under the Bihar Targeted P.D.S. (Control) Order, 2016.

The petition is dismissed as withdrawn with the liberty/direction aforesaid.
