The petitioner, who is in custody, seeks bail in connection with Dhaka (Panchpakari O.P.) P.S. Case No. 124 of 2018 registered for the offence punishable under Sections 420, 411, 413 of the Indian Penal Code.

Informant Priti Kumari, in her written complaint has stated that on 24.04.2018 at about 3.00 PM she was withdrawing Rs. 5000/- from the Punjab National Bank, Pachpakari Branch. In the meantime, a person (petitioner) came and began to help her in withdrawing the money and as soon as she withdrew Rs. 5000/- that person (petitioner) suddenly took out of Rs. 2,500/- from her and began to flee,

Patna High Court Cr.Misc. No.37577 of 2018(3) dt.06-09-2018 2/2 thereafter on her raising alarm that person (petitioner) was chased and apprehended by the police and on search, Rs. 2,500/- and four passbooks of different banks were recovered from his pocket and thereafter he disclosed his name as Umesh Prasad.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case merely on the basis of suspicion and the money recovered from his possession was his own money. It has been further submitted that both the parties have compromised the case. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 25.04.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahna, in connection with Dhaka (Panchpakari O.P.)
