2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 of the Indian Penal Code.

3. The case of the prosecution is that the informant is running a jewellery shop in the name and style of 'Ambika Jewellers' at Samastipur. On 10.10.2023, after closing his shop, he along with his staff namely, Manoj Paswan was returning home by bike and on the way when they reached in between Somra and Nagargama, two motorcycles chased them and

No.82828 of 2024(3) dt.04-03-2025 2/3 overtook his motorcycle and turned his motorcycle and snatched the bag containing 250 grams silver worth Rs. 8000/- and some grocery item from the informant. The case was registered against unknown miscreants. During the course of investigation, petitioner has given his confessional statement and in his confessional statement, he has confessed his guilt.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from his conscious possession and no Test Identification Parade has been conducted. Moreover, the petitioner is languishing in judicial custody since 19.02.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has 12 antecedent as stated in his bail petition.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sessions Trial No. 220 of 2024 arising out of Dalsinsarai P.S. Case No. 407 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District
