JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2018 The petitioner seeks regular bail in connection with Jamui Mahila P.S. Case No. 13 of 2018, registered for offences punishable under Sections 323, 341, 506, 376/34 of Indian Penal Code.

Allegation against the petitioner is of committing rape on the informant on the pretext of marriage and when she became pregnant the petitioner threaten to get the pregnancy terminated and refused to marry her.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and the girl herself is the lady of bad character and further petitioner has no criminal antecedent and has been in judicial custody since 16.04.2018. Learned counsel for the State opposed the prayer for bail

Patna High Court Cr.Misc. No.38847 of 2018 (6) dt.12-10-2018 on the ground that the age of the victim girl has been assessed to be fifteen years in medical examination and further the witnesses in paragraph 4, 10 and 11 have supported the case of prosectution. Having heard both sides, considering the fact and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

This application is, accordingly, dismissed.
