1. Heard Mr. Aryan Singh, learned counsel for the petitioner and Mr. Parmeshwar Mehta, learned APP for the State.

2. The petitioner apprehends his arrest in connection with Ranitalab P. S. Case No. 06 of 2025 dated 07.01.2025 registered for the offence(s) punishable under Section(s) 316(2), 316(5) and 318(4) of the BNS.

3. The main submissions advanced by the learned counsel for the petitioner are that as per the prosecution story the informant supplied 154.54 quintals of paddy to Barah PACS, of which the petitioner was president during the year 2020-21 and there is simple allegation of non-payment of Rs. 1,17,116/- relating to the supply of the said paddy but it is an admitted position that the informant has got a major part of the amount i.e. Rs. 1,71,884/- and in respect of the non-payment of Rs. 1,17,116/- he remained silent for four years which creates a

No.76615 of 2025(2) dt.03-12-2025 2/2 serious doubt regarding the genuineness of the allegation, in fact when the petitioner lost the election of the PACS Chairman in the year 2024, the informant lodged the FIR with false allegations under the influence of certain persons.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the above submissions, mainly the fact that the informant remained silent for four years with regard to the issue of non-payment of Rs. 1,17,116/-which is said to be dues on the part of Barah PACS, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Ranitalab P. S. Case No. 06 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
