Earlier the prayer for bail of the petitioner has been twice rejected by this Court with direction to the trial court to expedite the trial and dispose of the same as early as possible preferably within a period of six months from the date of receipt/production of copy of this order vide order dated 20.12.2017 passed in Cr. Misc. No. 53669/2017. The report of the trial court has been received wherein it has been mentioned that the case is posted for evidence after charge.
Learned counsel for the petitioner has submitted that this petitioner is in custody since 25.07.2017.
Patna High Court Cr.Misc. No.41711 of 2018 (3) dt.01-08-2018 2/2 Keeping in view the period of custody of the petitioner and the fact that the court below is not serious in early disposal of the case and the case is fixed for evidence after charge, the petitioner above named is directed to release on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Jamui in connection with Complaint Case No. 1955-C of 2015, subject to the conditions that the petitioner shall cooperate in the trial and shall remain present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner. Both the bailors will be close relative of petitioner.
