This is an application for regular bail in connection with Matihani P.S. Case No. 74 of 2015 registered for the offences punishable under Sections 302/201, 120(B)/34 of the Indian Penal Code and under Section 27 of the Arms Act. Petitioner is not named in the FIR. He has been implicated in this case on the basis of confessional statement made by co-accused Vikky Mishra, except said confessional statement, there is no incriminating materials against petitioner. It has been further submitted that similarly placed co-accused Kari Singh has been granted bail as contained in Annexure-2. Petitioner is in custody since 07.06.2018.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.43794 of 2018(4) dt.26-09-2018 2/2 let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai,, in connection with Matihani P.S. Case No. 74 of 2015.
