The petitioner is in custody since 30.03.2018 in connection with Samastipur Muffassil P.S. Case No. 167 of 2018 for the offence registered under Sections 363 366(A) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though it is alleged that the petitioner was involved in the alleged disappearance of the victim girl, the victim girl in her statement under Section 164 Cr.P.C. has merely stated that she had gone with one Rakesh Kumar of her own sweet will and has now married and she is living peacefully. It is further submitted that the petitioner has no role to play in the aforesaid offence and he

Patna High Court Cr.Misc. No.42615 of 2018 (3) dt.09-08-2018 may be extended the privilege of bail.

Diary of the present case was called for which has since been received.

Leaned counsel for the State after perusal of the case diary submits that the victim girl in her statement under Section 164 Cr.P.C. has not named this petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. - VIth in connection with Samastipur Muffassil P.S. Case No. 167 of 2018.
