JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 The petitioner seeks regular bail in connection with Azamnagar P.S. Case No. 281 of 2016, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R is that when the informant and one Javed Alam was going after closing the shop, the petitioner and others snatched away Rs. 60,000/- from the informant and Rs. 12,000/- and a mobile phone from Javed Alam and the petitioner was identified in CCTV footage.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has nothing to do with the allegation and so far his identification in CCTV footage is concerned, he has gone there for some work. Further he has been in judicial custody since 30.08.2017.

Patna High Court Cr.Misc. No.43631 of 2018 (4) dt.09-10-2018 Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and also the fact that petitioner has been identified in CCTV footage and apart from that he is an accused in fourteen other cases,, I am not inclined to release the petitioner on bail.

This application for regular bail is, accordingly, rejected. However, the trial court is directed to expedite the trial. (Vinod Kumar Sinha, J) sunil/- U T
