JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Banka Mahila P. S. Case No. 38 of 2016, disclosing offences under Sections 498A, 341, 323, 504, 307, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act. Petitioner happens to be the husband of the informant. There is allegation of demand of Rs.1,00,000/-, for that, assaulted her along with other accused and also tried to kill her by sprinkling kerosene oil and set her on fire. It further appears from the impugned order that there is superficial burn injury on different parts of the body.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. He is

Having heard both sides, in view of the allegations and also the burn injury on the person of the informant, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
