Petitioner apprehends his arrest in connection with Kanti P.S.Case No. 359 of 2017 registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping of daughter of the informant.

Submission of learned counsel for the petitioner is that the in her statement under Section 164 Cr.P.C. the girl has not supported the prosecution case of kidnapping and also not named this petitioner and petitioner happens to be uncle of Vikky Kumar, who is the main accused in this case. Further submission is that co-accused has been granted privilege of anticipatory bail by this

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate (West), Muzaffarpur, in connection with Kanti P.S.Case No. 359 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
