The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 379 of the Indian Penal Code.
The F.I.R. of the occurrence of theft of motorcycle is against unknown. The name of the petitioner surfaced during investigation in the confessional statement of co-accused, Anil Kumar @ Anil Kushwaha.
Submission is that Anil Kumar @ Anil Kushwaha is an accused in the case of murder of the full brother of the petitioner namely, Nezam Miyan, vide Lauriya Police Station Case No.217 of 2017. Petitioner has got no criminal antecedent,
Patna High Court Cr.Misc. No.51500 of 2018(4) dt.13-12-2018 2/2 nor anything has been recovered from the possession of the petitioner.
Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Srinagar Pujaha Police Station Case No.14 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
