2. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 115(2), 81, 89, 318(4), 352, 351(2) and 3(5) of B.N.S., 2023.

Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that she was in a relationship with Parwez Ansari who established physical relations on pretext of marriage and on account of which the informant became pregnant, but the pregnancy was aborted, further Parwez Ansari, before the Notary on 18.11.2024, sworn an affidavit along with her that they had married on 06.08.2023 at Sai Temle at Buxar, next alleges that they were living as

No.77734 of 2025(2) dt.02-12-2025 2/3 husband and wife for the last one year at Dumraon, further alleges that petitioner, who is elder brother of Parwez, called her and asked to leave and take Rs.2,00,000/- or to convert to Islam for validating the marriage, on refusal, petitioner threatened to kill her and when she disclosed the said fact to Parwez Ansari, he assaulted, further on 14.04.2025 Parwez Ansari came along with Samar Khan at 11:30 p.m. and both consumed liquor at her residence at Dumraon, thereafter Parwez Ansari assaulted and forcefully made physical relation and thereafter both fled when she said that case would be instituted, next alleges that she called the petitioner and informed him on which he said Parwez will not come back to her as he is getting married.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations, as alleged in the FIR, it would manifest that informant alleges that she was in a relationship with Parwez Ansari who had assured that he will marry her and on false promise of marriage, he established physical relation. It is further submitted that since petitioner is elder brother of Parwez Ansari, as such, he has been implicated in the instant case by the informant with a view to coerce Parwez Ansari into
Patna High Court CR. MISC. No.77734 of 2025(2) dt.02-12-2025 3/3 submission. It is next submitted that petitioner will not abscond rather will co-operate in the investigation to prove his innocence.
5. The learned APP opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, let petitioner, above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Buxar Mahila P.S. Case No.27 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
