The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 365 of the Indian Penal Code.

Submission is that the informant disclosed that his minor daughter went to withdraw amount from State Bank C.S.P. but she did not return. During course of search, the informant came to know that Sohan Das kidnapped his minor daughter. It is further alleged that when the informant went to the house of Sohan Das, his parents and other relatives abused and assaulted the informant.

Learned counsel for the petitioner submits that the allegation of kidnapping is against Sohan Das. The petitioner is

Patna High Court CR. MISC. No.70621 of 2019(2) dt.25-11-2019 2/2 brother of Soha Das. Nobody has seen the petitioner kidnapping the victim. The petitioner has been made accused in the case only because he happens to be close relative of Sohan Das, but Soha Das is already in jail.

Learned counsel for the petitioner further submits that the petitioner is in custody since 06.06.2019 and has got no criminal antecedent. The co-accused have been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 20.09.2019 in Cr. Misc. No. 58556 of 2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua (Vaishali) P.S. Case No. 283 of 2019.
