====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-11-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, on 01.10.2022 at about 5:30 AM, while informant along with his uncle and cousin brother was doing morning walk, F.I.R. named accused persons, namely, Veerbansh Singh and Balmiki Singh came upon motorcycle and Balmiki Singh fired upon his uncle with pistol resulting in his death.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during course of investigation. He next submits that informant claims to be
Patna High Court CR. MISC. No.76716 of 2025(2) dt.17-11-2025 2/2 eye witness of the occurrence and it is specific case of informant that co-accused Veerbansh Singh and Balmiki Singh fired upon his uncle with pistol. There is no whisper nor any suspicion has been raised against this petitioner in the entire F.I.R.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Madhuban P. S. Case No. 418 of 2022, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
