The petitioner seeks bail in Nagar (Rahika) @ Rahika P.S. Case No. 13 of 2007 instituted for the offence under Section 306/34 of the Indian Penal Code.
Counsel for the petitioner submits that from the written report it is apparent that son of the informant himself had committed suicide and his dead body was recovered from the room after breaking open the lock. Police has submitted charge sheet against co-accused Sita Ram Sah for the offence under Section 306 of the Indian Penal Code. Thereafter, the police apprehended the petitioner and has submitted charge sheet against the petitioner under Section 302 of the Indian Penal Code.
Patna High Court Cr.Misc. No.53362 of 2018 (3) dt.29-10-2018 2/2 Petitioner is said to be in custody since 1.7.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Madhubani, in connection with Nagar (Rahika) @ Rahika P.S. Case No. 13 of 2007, subject to the condition that both the bailors will be the close relatives of the petitioner.
