1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 109, 352, 351(2) and 3(5) of the BNS.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case but then the case is of the year 2002 and the informant alleges that on account of dispute relating to passage, three named accused persons including the petitioner came and assaulted him causing injury on his head, thereafter Vikash and Subhash assaulted the wife of the informant by lathi causing injury. Further Niraj and Khusboo assaulted Mahesh, the brother of the informant by rod causing injury on his head and lips. Further, Manoj Devi and Rakesh assaulted Surendra by rod causing injury on his head and above

Further, petitioner and Ramlakhan assaulted Ranju Devi and threatened and snatched Mangalsutra of the wife of the informant and Vikash also threatened with gun.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that on account of dispute relating to passage, an altercation took place in which both sides assaulted each other. It is next submitted that no specific allegation of assault is alleged against the petitioner. It is also submitted that though petitioner has antecedent of one case but then the said case is of the year 2002 and thereafter petitioner has remained a person with clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees One Thousand) with two sureties of the like amount
