JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks regular bail in connection with Jogbani P. S. Case No. 28 of 2019 registered for the offences punishable under Sections 20, 22, 23 and 24 of N.D.P.S. Act. Recovery of 7.3 Kg of Ganja from the house of the petitioner. Apart from that some Nepali currency has also been recovered from the house of the petitioner and her husband. Submission of learned counsel for the petitioner is that recovered ganja is less than the commercial quantity. She is in custody almost a year. She has no criminal antecedent. Further submission is that her husband already been granted bail by a Co-ordinate Bench of this Court, vide order dated 19.11.2019 passed in Criminal Misc. No. 62212 of 2019. Heard learned A.P.P. also.
Having heard both sides, in view of the submissions,
Patna High Court CR. MISC. No.73931 of 2019(3) dt.20-01-2020 2/2 made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned District and Sessions Judge, Araria, in connection with Jogbani P. S. Case No. 28 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial, otherwise her bail bonds shall be cancelled.
