====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 23-04-2025 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.
2. The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 239 of 2014, registered for the offences punishable under Section 392 of the Indian Penal Code.
3. As per the prosecution case, the informant and his father while on their way to their home, were confronted by four miscreants on two motorcycles. The miscreants deliberately collided with the informant's motorcycle and subsequently escaped with a bag that contained cash.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence and no incriminating looted article has been recovered from the
Patna High Court CR. MISC. No.89363 of 2024(3) dt.23-04-2025 2/3 possession of the petitioner and the name of the petitioner has surfaced during the investigation on the basis of confessional statement of one Randhir Kumar and the petitioner is in custody since 06.05.2024. Learned counsel further draws the attention of this Court towards the order dated 30.08.2024, passed in Criminal Misc. No. 61597 of 2024, which has been brought by way of Annexure-1, wherein the previous application for bail was rejected, however, the Co-ordinate Bench of this Court had granted liberty to the petitioner to renew his prayer for bail after framing of charges. Lastly, the learned counsel has submitted that charges against the petitioner has been framed on 17.10.2024.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances and taking into account the previous observations given by a Co-ordinate Bench of this Hon'ble Court, I am inclined to grant the petitioner privilege of regular bail.
7. Accordingly, the prayer for bail is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court
