2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 143 (1), 143 (5), 144 (1), 144 (2), 64 (1), 111 and 61 (2) of the BNS, 2023 and Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act. 1956 as also Sections 4 and 8 of the protection of Children from Sexual Offence Act, 2012 as well as Sections 75 and 79 of the Juvenile Justices (Care and Protection of Children) Act, 2015.

3. The case of the prosecution is that on the basis sof secret information, the police conducted a raid at the house of

Patna High Court CR. MISC. No.76390 of 2025(2) dt.19-11-2025 2/3 Akhilesh Nat, Raju Nat, Sunil Nat, Vijay Nat and Daiji Devi. From a perusal of the FIR, it is clear that these petitioners were found in a separate room, and except these two ladies, no one else was there. It is further evident that no objectionable material was recovered from that room.

4. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that although certain objectionable materials were recovered but that is from different room. It is further contended that from perusal of the order of the trial Court, it transpires that the victims in this case have given their statement under Section 183 of the BNSS and have categorically stated that they were not forced into any kind of immoral activity. Moreover, the petitioners are ladies, have no criminal antecedent and are languishing in judicial custody since 12.09.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sasaram (M) P.S. Case No. 303 of 2025

Patna High Court CR. MISC. No.76390 of 2025(2) dt.19-11-2025 3/3 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge - VI cum Special Judge (POCSO), Rohtas at Sasaram.
