2. The present Cr. Misc. application has been filed for modification/extension of time granted to the petitioner by this Court vide order dated 18.09.2024 passed in Cr. Misc. No. 49259 of 2024.
3. Learned Counsel for the petitioner submits that vide order dated 18.09.2024, specific direction was given to the petitioner to surrender before the Trial Court within four weeks from today i.e. 18.09.2024, but inadvertently, wrong counting has been done from the counsel, as such, delay of 3 days took place and in result, petitioner could not surrendered himself
Patna High Court CR. MISC. No.85395 of 2024(2) dt.18-01-2025 2/2 before the Trial Court within time. Counsel further submits that in future, such mistake shall not take place and he shall comply the order within time.
4. In the light of the submissions made by the counsel for the petitioner, two weeks' time from today is hereby granted to the petitioner to surrender himself before the Trial Court and then petitioner may prays for regular bail and the Trial Court shall consider the bail application of the petitioner on the same day on merit including the injury report without being prejudice that the anticipatory bail of the petitioner has been rejected by this Court.
5. Accordingly, present Cr. Misc. application is hereby allowed and order dated 18.09.2024 passed in Cr. Misc. No. 49259 of 2024 is hereby modified up to that extent. (Dr. Anshuman, J) Divyansh/- U T
