2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 392 of the Indian Penal Code.

3. As per prosecution case, the allegation against four unknown miscreants is that they boarded on motorcycle came and on the point of weapon looted money of Rs. 1,25,700/- from the informant and fled away.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He is not named in the F.I.R. Only on the basis of confessional statement of co-accused Md. Naushad @ Naushad the name of the petitioner has been dragged in this

Patna High Court CR. MISC. No.82180 of 2023(2) dt.19-12-2023 2/2 case. He has no concerned with the alleged occurrence. Nothing incriminating article and looted money has been recovered from his conscious possession. Petitioner is languishing in judicial custody since 10.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Madhepura in connection with Shankarpur P.S.
