JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Magadh Medical P.S. Case No. 114 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 353, 332, 333, 307 of the Indian Penal Code. The accusation against the petitioner is that he as well as several other person got released the seized tractor from the police and also attacked on the police party while police party was carrying seized tractor loaded with sand. Moreover, having similar allegation, co-accused persons namely, Akchaya Kumar, Sanjay Kumar and Gautam Kumar have already been granted privilege of anticipatory bail

Patna High Court CR. MISC. No.71814 of 2019(2) dt.27-11-2019 2/2 by a co-ordiante Bench of this court vide order dated 25.09.2019 passed in Cr. Misc. No. 61002 of 2019, therefore, with an object to maintain parity of justice, I think it proper to extend the privilege of anticipatory bail to the petitioner. Accordingly, it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Magadh Medical P.S. Case No. 114 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
