====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. Allegation is that diesel was looted from a vehicle on the point of pistol. The petitioner was arrested on suspicion on 19.06.2017. Thereafter, he was put on T.I. Parade on 6th July, 2017 and was identified by the witnesses.

This Court had not granted bail to the petitioner on 31.01.2018 in Cr. Misc. No. 54677 of 2017 with liberty to renew the prayer for bail if the trial is not concluded within a

Patna High Court Cr.Misc. No.52981 of 2018 (3) dt.31-10-2018 2/2 period of six months from the date of receipt of a copy by the learned court below.

The report of the learned trial Judge would reveal that the case is at pre-committal stage due to non-appearance of another absconding co-accused.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Triveniganj Police Station Case No. 198 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and keep the petitioner in jail till conclusion of the trial as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
