====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-07-2020 Heard learned counsel appearing for petitioners as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioners apprehend their arrest in connection with Lalganj P.S. Case No. 226 of 2019 registered for the offences punishable under Section 304 (B)/34 of the Indian Penal Code.
Petitioners No. 1, 2 and 3 are elder brothers-in-law, whereas petitioners No. 4 and 5 are Gotanis of the deceased. No doubt, deceased died within twenty days of her marriage and some injuries were found on her person but,
Patna High Court CR. MISC. No.70409 of 2019(4) dt.08-07-2020 2/2 the Case Diary goes to show that no specific overt act has been attributed against the petitioners.
However, it is submitted on behalf of the petitioners that the petitioners are separate from the husband of the deceased and moreover, parents-in-law of the deceased have already been granted anticipatory bail by this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners in the event of their arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 226 of 2019 subject to conditions as laid down under Section 438
(2) of the Cr.P.C.
